The man accused of hitting and killing a North Texas Kindergarten teacher heads to court on Monday.
It's been five years since the horrific crash killed Leann Selkirk and her unborn child.
Selkirk's husband, Alex, wants justice for his pregnant wife's death. After five years of court delays, new judges and five prosecutors, the driver indicted for killing her, finally is going to trial.
The Anna kindergarten teacher was driving to work on April 30, 2007.
Alberto Espinosa had been driving a dump truck, when his brakes failed and the truck jack-knifed, landing on Selkirk's car, killing her. She was 18 weeks pregnant.
Selkirk was just blocks from her home that she shared with her husband. Alex Selkirk had been working outside and heard the crash.
Espinosa has been indicted for criminally negligent homicide, but there have been several delays in the case.
"Now that it's just been drawn out so long, it's just so frustrating," said her husband, Alex Selkirk.
For the past five years, Selkirk's been living without his wife, while seeing Espinosa around town continuing to live his life.
"I see him almost every day driving down the road, and that's hard to see him and know what he took from me," Selkirk said.
Espinosa's trial is set to start Monday at 1 p.m.
Selkirk is expected to be the first to testify against his wife's accused killer.
"Until this is over one way or another, I can't move past that," Selkirk said.
